Reason the ban should be lifted.The ban given to my by Aelgalden was unjustified and his reasonings, evidence, and understanding of the events that unfolded were incomplete. The issue at hand is an altercation between myself and brad. During the altercation, both brad and MacKinnon were breaking rule #4 by attempting to instigate me. They were standing right at the border of a line drawn in the map requesting that it not be passed as Woadhawk and I were clearing out a town alone. When trying to address them on TFR and in chat, there was no response. In order to get their attention, a shot was fired about 10-20 meters off the the right of both MacKinnon and brad. It was then repeated in chat that I wanted them to leave. In response to this, brad began firing at the tower that Woadhawk and I were in, which caused me to be hit by several bullets. Later after this, I was asked to join a TeamSpeak channel with brad and Aelgalden. On joining, I was asked why I was trying to kill brad. I said multiple times that I was not trying to kill brad. Brad then stated that I had shot him several times, causing him to have to heal himself. My response to this was simply that it was impossible that I had ever hit him with a single bullet that I fired as the 6.5mm round would have knocked him unconscious making it impossible for him to heal himself which he stated that he did. After hearing this, brad began cursing at me, which Aelgalden ignored. After about a minute or so of this, Aelgalden left the channel without saying a word. I too left the channel soon after. I continued playing Sabotage after this for about 10 minutes or so. Suddenly a message appeared on my screen saying that I had been kicked/banned from the server. I looked back in TeamSpeak to find brad, MacKinnon, and Fox all in a channel with Aelgalden (mid you that Fox had been nowhere near the town in which this happened). When I asked Aelgalden why I was banned, he said that brad, MacKinnon, and Fox all stated that I shot brad. When I explained the situation, Aelgalden became more and more furious. Rollacanda joined the chat a short while later and asked what had happened. I explained that I had been banned by Aelgalden and the reasons as to why he stated he banned me. I also explained why I felt the ban was undeserved/false. Aelgalden then joined the chat during this and continued to state that I broke rules #3 and #4, even though I hadn’t. He then said I was breaking rule #10. More and more Aelgalden stated that I had broken those rules and I deserved the ban, even though he admitted no proof was provided and that if I had in fact shot brad, brad would have died, meaning brad lied in his report to Aelgalden.

Please note:
*All bans are reviewed on a case by case basis.
*The banning admin and head admins have the final say on whether or not a ban should or shouldn’t be modified.
*Admins and players, can be used as witnesses to make statements for or against the ban modification.
*Any bans regarding hacking, cheating, and or code manipulation/ game engine manipulation will not be lifted. We check logs daily and do offline bans as well.
*Racist, sexist and xenophobic remarks will not be lifted, this indicates the attitude of the player, ability to work as a team, and potential toxicity.
*Lying in your appeal, is cause alone for a ban not to be lifted and may be cause for a ban to be extended, this indicates the integrity of the player, and the trust among other players.

To justify the reasons on why I have given this ban for the rules #3 & #4 are because in my opinion shooting at frienlies and hitting one causing them to need medical attention in-game breaks the rule #3 for intentional team killing since you had directly shot them with what rifle you were using, for banning you on rule #4 was because you were shooting multiple times at friendlies the entire session you had played on the server even if there is a line drawn on the map and text going along the lines of “You cannot enter or you will be shot” and typing in chat threatening other players is not a good reason to shoot at them it is a open server you do not own a part of the map players can go wherever they please as seen here in a screenshot of a player in the server before you started shooting at them.

May I remind you Aelgalden, not a single shot fired from my machine gun struck any other players in the game. Had they in fact struck a player, it would have been more than clear that it connected. Had I in fact caused damage to a player, I would not be refuting this ban. Regarding my reason for shooting in their direction, it was to get their attention as they were not responding on TFR or in chat after being asked multiple times. Rule #3 is, as you yourself stated, intentional team killing. Considering I had not even caused the player in question a single instance of damage, it is more than impossible for me to have broken this rule, as I had explained earlier in TeamSpeak. Rule #4 is “Definition: Griefing/Harassment are viewed as the act of INTENTIONALLY irritating and angering people through the use of destruction, language, forcing team kills, being a general annoyance to the server and more”. In no way can it be argued that I was intentionally trying to irritate or anger anybody. Woadhawk can attest to this. The only thing I was attempting to do was request that both MacKinnon and brad leave the area instead of trying to irritate/anger me by standing directly on top of the circle I had drawn around the town. May I remind you that I originally was not the person to drawn said circle, MacKinnon was. After I had requested at spawn that nobody follow me into the town, MacKinnon drew a large blue circle around the town and added text in the middle stating that nobody else except for me should enter the town. Therefore it cannot be suggested that me redrawing a line that had been drawn by on of the people accusing me was being done to intentionally anger/irritate somebody. In the screenshot you provided, it clearly shows the same blue circle drawn by MacKinnon still on the map around the town. The one I had drawn was in red, just inside the one he had drawn.

Players had seen you shoot and hit another player as I stated before in the post, and for trolling you had copied or typed that “Definition: Griefing/Harassment are viewed as the act of INTENTIONALLY irritating and angering people through the use of destruction, language, forcing team kills, being a general annoyance to the server and more” in which this case another player had got angry at you and fired back in retaliation meaning you had angered someone into teamkilling in which they had got punished for it also so by shooting at friendlies made this part of the ban happen.

To be so focused on supporting a lie is unbelievable to be honest. It’s hard to understand as to why you are building more and more lies that are so easily torn apart. The rule in and of itself states that it would have to be intentional, meaning it had to be proven that I intentionally fired near them in the hopes of angering them and expecting them to fire back. Not only is there not a single bit of proof associated with this case against me, but you stated that Fox saw the event, which both myself and Woadhawk can say is false. If he was even in the server at all at that time, he wasn’t even close enough to be seen on the map when I zoomed out to see an overview of the town and it’s surroundings, stretching all the way out to the spawn. Don’t believe every lie people tell you Aelgalden, they can get you into trouble. Especially if you continuously create more lies to support it.

Hey Lastxbreath don’t make up crap i was standing next to mackinnon and brad when you started shooting at us and by the way we where trying to set up radios and attack a different town. So anyway i chose to stand there with no weapon in my hand while you shoot at us, to see if you would kill one of us and the only reason you couldn’t see me is because i impersonated an enermy just before you started thank you very much and you accuse Aelgalden of lying when you said in the misconduct report “Lying in a response to a ban appeal is likely not tolerated among staff members, Aelgalden, and I would strongly advise against it”. So please make up something to comeback at that i would love to see it!

I stand corrected, brad was not in the channel when I moved to it, however he was moved in to talk to aelgalden shortly after. My apologies. However there are a few things you have wrong.
Brad later being moved in to speak with Aelgalden:
You and Aelgalden were not the only ones in that channel as proven by the Teamspeak logs shown above. You, Aelgalden, and MacKinnon were in the channel together when I joined. So you lied about that.
If you look at this picture (from the previously provided screenshot from Aelgalden), it is easy to see that you were nowhere near them, even though you insist you were standing right next to them.

well my bad but i was there because i was impersonated so your not able to see me on the map and even so you should know better not to shoot at friendlies full stop. Your in NAK TAC and your a sergeant. Oh and i never seen your messages so if you got those please show me because i can’t remember them even saying get out or something, but like i said the only reason why we where there was because Mackinnons radio wasn’t working so we where trying to fix it. But you wanted to act like a 12 year old on the server showing new players what NAK is about.

Regardless of whether or not you are impersonating some random CSAT that you killed, you will always show up on the map to friendlies, as shown with both brad and MacKinnon in the screenshot. Even if MacKinnon’s radio wasn’t working, brad would have had one as well and both of them could have just read the chat. In no way were they completely unable to see or hear what I was saying. Lastly, I was not shooting directly at them, but several meters to the side where it couldn’t possibly cause any kind of damage. The clear intention of the single bullet fired at the ground was to get their attention. If their communications truly were down and they were unable to hear me or see the messages in chat, that was the best way to get their attention given the circumstances (the town was still full of enemies that were actively shooting anything on the streets and anything on the eastern side of the tower, which means that it was impossible to run over to them and ask as the AI would have killed me).

So, the question at hand is whether the 1-Day ban that was placed should be lifted.

In your statement you were frustrated that 2 other players were encroaching on a barrier line that was drawn on the map. You fired a warning shot in the general direction of friendlies to prevent them from crossing that line. The friendlies of the directed fire returned fire and struck you.

Admin Aelgalden reports he received information that you had fired a shot that struck another player.

The ban was put in place for violating rules #3) Intentional Team Killing and #4) Griefing / Harassing.

Based on the information provided it is clear that friendly fire was at play, regardless of the intent. Friendly fire was reported to have struck both sides, though that point is in contention.

I did review statements that were made by yourself in server chat covering a 5 minute period of time leading up to the initial kick and they include the following:

Although rule #3, by the letter, is not entirely accurate for the punishment, it can be interpreted that attacking teammates is also not acceptable. So, had the initial shot that you fired been removed from the equation, would the responsive action that took place have occurred? Or, was that initial shot the instigation to the impending action?

Regarding rule #4, you feel that this was a violation against you as other players were encroaching a boundary line placed on the map. In response to that perceived rule violation, you decided to fire the first shot. At the same time, the above listed server chat logs show threatening statements of your intent to violate rule #3, by the letter of that rule, if others do not follow your directive.

The last statement that you made resulted in an auto-kick from the server for violating rule # 14) No use of indecent; obscene; lewd; sexually explicit language – this includes any words generally considered curse words.

20 minutes after your return, the ban went into effect. I can only assume the admin(s) involved was deciding if an infraction(s) took place, what the appropriate response should be and what would end the server disruption.

Both server rules #3 and #4 carry a first time weight of a 1-day ban each and rule #14 carries a first time weight of a kick. If it was determined you were guilty of either #3 or #4 independently, the 1-day ban you were given would be appropriate. If it was determined you were guilty of both, a 2-day ban would be appropriate. And if it was taken into consideration you were already kicked for a rule violation (#14) with the other two potential violations still at hand, a more lengthy ban would be appropriate.

At the top of the server rules page there is the following statement, "The level of punishment is at the discretion of the Admin, and will be based on the severity of the action. If you break multiple rules your punishment may run consecutively. "

At the bottom of the server rules page there is also the following statement: “This page does not cover all the rules; only the basic ones. If an Admin finds an unfitting behavior he will moderate it accordingly.”

Based on the information provided, I find it justified that a 1-day ban was given. A ban was also given to Brad as both parties were causing a disruption to the server. The bans will hopefully be a long enough cooling down period for both sides, where considerate game play can resume by both in the future.

I support everything said by CopOut, there is just one thing that I want to make clear to everyone, you can not draw a mark on the map and tell other players that they can not enter that area. This is a “public” server and everyone is allowed equal access to the tasks and missions.

If a player is being disruptive and not playing the mission as intended then report them to an admin, but as long as the player is making efforts to play the mission as intended, everyone is free to play.

If you want to complete missions by yourself, start your own private server.

No matter what led up to the situation, the statements made in chat “Go away MacKinnon”, “Next shot is in your head”, “This either ends with you leaving or you dying” are extremely inappropriate, and are not the words from a person that wants to be part of a community.
